CASE OF PREM SINGH AND EUROPEAN COURT OF HUMAN RIGHTS

The motion

That this House considers that the decision of the European Court of Human Rights in the case of Prem Singh (56/1994/503/585) is an unwarrented interference in the internal affairs of the United Kingdom, based on an exorbitant interpretation of Article 5(4) of the European Convention on Human Rights; calls upon the Court to resist the temptation to overrule democratically elected national parliaments save where there is a clear and unequivocal breach of the convention; and calls upon Her Majesty's Government in the event of future interference to serve six months notice under Article 65(1) to withdraw from the Convention.
