HUMAN RIGHTS ACT 1998 AND PRIVATE CARE HOMES

The motion
That this House is concerned that the Human Rights Act 1998 does not extend to private care homes; notes that the Law Lords have ruled that the definition of public authority in the Act does not extend to residents of privately run care homes even where the resident's place is funded by the taxpayer; believes that Parliament had intended that such residents should be protected; and calls on the Government to close this human rights gap and ensure equal treatment between the residents of public sector care homes and private care homes.
