Baroness Jones of Moulsecoomb moved amendment 18, in clause 3, page 4, line 21, at end to insert—“(8A) In proceedings for an offence under subsection (2) it is a defence to show that the person engaged in the conduct in question was acting with a view to publication of material by a recognised news publisher as defined in Schedule 15.”The House divided:
