It was moved by the Lord Ackner, in Clause 154, page 92, line 44, at end to insert: “( ) Nothing in subsection (1) shall fetter the judges’ overriding discretion in the individual case to set the sentence he thinks is appropriate.”; which being objected to, the question was put thereupon, and the House divided:
