To ask the Scottish Government, further to the House of Commons Library Standard Note SN/SC/1295, what consideration it has given to whether local authority planning application committees in Scotland qualify as an “appropriate tribunal” under Article 6 (civil) of the ECHR.

The question of compliance of planning legislation with Article 6 of the ECHR was considered by the House of Lords in the case of Alconbury v Secretary of State for the Environment, Transport and the Regions. In the Court’s 2001 decision it was found that the nature of the decision making process and the right to challenge decisions in the courts was sufficient to provide an Article 6 compliant procedure.

Councils are independent bodies with their own powers and responsibilities and are entirely separate from the Scottish Government. The Scottish Government believes that locally elected representatives are best placed to consider the needs of their communities.Councils are responsible for considering their own options for reform and transformation, in line with their statutory responsibilities and local priorities. The Improvement Service supports councils to develop capability and capacity for improvement to enhance the delivery of high quality, efficient local services.The Scottish Government continues to work in partnership with local government and other public sector partners through the Public Service Reform programme to improve the design and delivery of services, strengthen collaboration and identify opportunities for efficiencies, while ensuring that services meet the needs of local communities.

In our manifesto we committed to implementing the stepped care approach to support for adults with neurodevelopmental conditions such as autism and ADHD, as proposed by the Royal College of Psychiatrists. This will expand support to meet people’s needs, whether or not they have a diagnosis, and make accessing support easier by shifting care to community services.Within the first 100 days of this Parliament, we will meet with stakeholders to agree a route map and timeline for implementation.

SFRS continually reviews its operational response concerning emerging technology, including battery storage, to keep communities safe and has the ability to deploy a range of resources that can be utilised by highly skilled crews to successfully bring incidents to a safe conclusion.

The Scottish Government recognises the importance of maintaining a safe, high-quality NHS estate and we are aware that there remain a substantial backlog of maintenance which Health Boards are actively managing and prioritising based on risk and patient safety.The Scottish Government does not hold a centrally collated figure for the total outstanding works on the NHS estate that arise specifically from inspection reports.The responsibility for identifying, prioritising and delivering estate improvements rests with individual NHS Boards, who are required to ensure that their facilities are safe, fit for purpose and compliant with relevant standards.

The second Strategic Transport Projects Review (STPR2) appraised a potential new rail link between the Highland Main Line (HML) and the West Highland Line (WHL). However, this option did not progress beyond the Preliminary Appraisal stage, and there are currently no plans to develop a direct connection between the two lines.
