Where the police have reasonablecause to suspect a particular person has committed a crime the suspect should becautioned as this warns them that they will be asked questions but they are notobliged to answer.</p>

In terms of section20 of the Road Traffic Offenders Act 1988, unless it is challenged by the accused,a record produced by a type approved device and a properly served certificate asto the circumstances in which the record has been produced can be sufficient evidencein law of the speed at which the vehicle was travelling.</p><p>However, the identityof the driver requires to be corroborated (unless the accused has submitted a signedstatement admitting that he or she was driving the vehicle at therelevant place and time).</p>

Not all speed measuring equipmentused by the police requires statutory approval and the decision as to the equipmentdeployed within each force area is an operational matter for the Chief Constable.</p><p>Where the police wish to relyin court on evidence from speed meters, the devices used must be of a generic natureprescribed in a statutory instrument which has been subject to the negative resolutionprocedure in the UK parliament. In addition each specific example of a generictype is subject to a separate type approval order made by UK ministers.These orders, which are not subject to parliamentary approval, are granted on individualmakes of device sold by different manufacturers. Before approval is granted in anyindividual case, the equipment is subject to testing to ensure that it is technicallyreliable and robust, can produce accurate readings under a variety of conditionsand is operationally practical.</p>

To ask the Scottish Executive whether it has sought the advice of civil servants to establish whether the powers granted under The Scotland Act 1998 (Transfer of Functions to the Scottish Ministers etc.) Order 1999 (SI 1999/1750) could be invoked to enable it to prevent flights landing in Scotland which are carrying munitions from the United States of America to Israel and, if so, what advice was proffered.

The purpose of the relevant powerunder section 78(3) of the Civil Aviation Act 1982 is to limit or mitigate noiseand vibration from aircraft. This power cannot be used to prohibit aircraftfrom landing at Scottish airports for reasons other than noise or vibration.</p>
