Two Verdict Jury Trials

The motion

That the Parliament recognises the recent Scottish Government publication, Scottish Jury Research: findings from a large-scale mock jury study; understands that there is some confusion among jurors and the wider public over the distinction between "not proven" and "not guilty"; acknowledges that the task of a jury is not to uncover an ultimate truth but rather to pass opinion on a presentation of evidence; believes that having a system of only two verdicts, "proven" and "not proven", would reduce confusion, and considers that this would more accurately reflect the role of jurors and the justice process.
