European Court Rules that Lifting Turkish MP Immunities Contravenes Human Rights

The motion

That the Parliament notes the reported decision of the European Court of Human Rights (ECHR) to rule that the Turkish government’s move to lift the political immunity status of 40 members of parliament from the opposition Peoples' Democratic Party (HDP) as unlawful; understands that, following this constitutional amendment, criminal proceedings were brought against the MPs en-masse without consideration of individual cases, and that since then 14 MPs have been remanded in custody; further understands that the Turkish government previously revoked the political immunities of the former HDP leader and a fellow MP as a result of the amendment and refused to implement ECHR judgements on their cases; believes that lifting their immunity infringes on Turkish MPs’ rights of freedom of expression and freedom of assembly as per Article 10 of the ECHR; strongly opposes what it sees as the sustained campaign of oppression orchestrated by the current regime against the Peoples' Democratic Party, human rights groups and independent media outlets in Turkey, and calls upon the Turkish government to comply with the rulings of the European Court of Human Rights.
