To ask the Scottish Executive whether it is satisfied that the Scottish Outdoor Access Code meets the objective of providing guidance in determining whether or not land is subject to access rights under the Land Reform (Scotland) Act 2003.

The code provides guidance on the extent and nature of accessrights in accordance with the requirements of the act. Only the courts can finallydetermine whether access rights apply in relation to any particular area of land.

Slavery is a terrible and unacceptableevil. In today’s world, there is no place for the trafficking in human beings forsexual exploitation or forced labour.Later this month, the ScottishExecutive and the Home Office will publish our Joint Action Plan on Human Trafficking.The plan will focus on four key areas: prevention; enforcement and prosecution;victim support, and child trafficking.The Executive will work closelywith the UK government, police forces, local authorities and otherstakeholders to implement the recommendations in the Action Plan and to ensure thatScotland meets its responsibilities under the Council of Europe Convention AgainstTrafficking in Human Beings.

To ask the Scottish Executive, further to the answer to question S2W-20437 by Mr Tom McCabe on 5 December 2005, whether it is now in a position to give a more accurate prediction of when it will pay out the remainder of the £126 million which it agreed to pay out in ex gratia payments from the Scottish Transport Group pension funds surplus.

It is not possible tospeculate when the remainder of the £126 million will be paid out. This willdepend on the number and frequency of valid claims received from former membersof the Scottish Transport Group pension scheme. Information relating to potentialapplicants has been available on the SPPA and Transport Division web pages since2005.Since 2005, SPPA havereceived valid claims totalling £83,000, and this leaves £167,000 available fordistribution.

The Scottish Executive is mindedto ban the use of devices that cause pain and distress unless there is a good casefor them to be permitted. However, before any decision is made on whether to banthe sale and use of electric shock collars, it will be necessary to consult andseek views from organisations and individuals which oppose and support the use ofsuch devices. Therefore we plan to issue a consultation paper seeking views on electronicdog training aids which administer an electric shock later this year. A decisionon whether to bring forward regulations to ban their use and sale will be made inthe light of any consultation.

To ask the Scottish Executive how much has been allocated to local authorities for delivering the access provisions set out in the Land Reform (Scotland) Act 2003; how much of that money has been spent on delivering access, and how much has been diverted to other functions, broken down by local authority.

Following the introduction ofPart 1 of the Land Reform (Scotland) Act 2003, additional funds of £29.2 million were includedin the local government settlement for the period 2001-02 to 2005-06 for accessrelated activity. A further £8.1 million was included for 2006-07 and for 2007-08.These sums form part of the total block grant allocation and areallocated to local authorities as part of the GAE provision.The Scottish Executive has establisheda monitoring scheme to collect information from local authorities on the progressachieved in the delivery of access measures. Progress information is collected ona bi-annual basis and expenditure information on an annual basis. No. Secondary school classsize data is not routinely collected. A special collection of S1 to S2 mathsand English classes will be made as part of the 2007 school census to establishwhether our target of reducing those classes to a maximum of 20 by August 2007has been achieved.

To ask the Scottish Parliamentary Corporate Body which parliamentary employees are eligible for the healthy living and well-being allowance; how many receive it, and what the total annual cost is of the scheme.

The Healthy Living and Well‑beingScheme is open to all SPCB staff, including seconded staff who were with the Parliament before 1 April 2000 and will continue to be paid by us direct. Thescheme is also open to secondees who are employed under SPCB terms andconditions of employment.The number of claimantsfluctuates from year‑to‑year. However, for the period from 1 August 2005 to 31 July 2006 192 staff made a claim.The annual cost willsimilarly fluctuate depending on the number of claims submitted. For the sameperiod as above, the cost of the scheme was £32,528.25.The current maximum amountthat can be claimed in any one year by an individual is £263. This isincreased annually in August in line with RPI figure at April.
