90th Anniversary of Donoghue v Stevenson: The Immortal Snail
The motion
That the Parliament commends the Law Society of Scotland for celebrating, on 26 May 2022, the 90th Anniversary of the famous case of Donoghue v Stevenson [1932] Session Cases (HL) 32, which, it understands, laid the foundations of the law of negligence in common law countries across the world; pays respect to May Donoghue, who it understands was a very poor woman, who, having had gastro-enteritis, challenged precedent and, with the help of her solicitor, Walter G. Leechman, was able to take her case to the Appellate Committee in the House of Lords; believes that her tenacity, strength of character and will power ensured that she was able to ignore past defeat and submit her case to the highest court in the land, and considers that the victory she secured made certain that the law was changed, and that consumers could have a remedy against the manufacturers of dangerous goods and harmful products made without due attention to the underlying duty of care.
