Legal Aid, Sentencing and Punishment of Offenders Bill
Baroness Grey-Thompson moved Motion D1, as an amendment to Motion D, at end to insert “but do propose Amendment 24B as an amendment in lieu”. Page 21, line 7, at end insert: “( ) Notwithstanding subsection (1), the Lord Chancellor’s duty to a person eligible for legal aid advice under section 1(1) must include: (a) a duty to secure the provision of initial face-to-face advice; and (b) a duty to secure the provision of legal aid advice in a range of forms, taking account of the needs of the person eligible for such advice (“the client”), including: (i) the client’s vulnerability; (ii) the client’s capacity to represent himself or herself and communicate his or her case, including any written documentation; (iii) the client’s health (including mental health) issues; (iv) the impact and consequences on the client, or his or her family, of failing to receive advice and assistance under this Part; (v) the age of the client; or (vi) that it is otherwise in the interests of justice.” The House divided:
