Lord Hunt of Kings Heath moved amendment 168B, as an amendment to amendment 168A, after clause 109, in line 14, at end to insert: “( ) Before section 65F of that Act insert: “65ZF Trust special administration: measures required before powers take effect No power under this Act for the administrator to recommend taking action in relation to another NHS foundation trust or an NHS trust, or for any such action to be taken, shall be exercised until: (a) at least 5 years have passed after the passing of the Care Act 2013; (b) the Secretary of State has reported to both Houses of Parliament on the case for the operation of such a power; and (c) an order made by statutory instrument giving effect to the recommendations of such report has been laid before and approved by a resolution of both Houses of Parliament.”” The House divided:
