Sections 25-29 of the Law Reform(Miscellaneous Provisions) (Scotland) Act 1990 came into effect on 19 March 2007.Guidance for professional or other bodies on making an application to enable theirmembers to acquire rights to conduct litigation and rights of audience is availablefrom the Justice Department. Copies are also held in the Scottish Parliament Information Centre.

Reaching Higher defines the role of local authorities in taking a strategicapproach to the provision and management of sports facilities within their corporateasset management strategy. The revised strategy also states that local authoritiesshould liaise with sportscotland and sport governing bodies and take into accountthe needs of local communities in planning for sports facilities.The City of Edinburgh Council announced its intention to replace Meadowbank Sports Centre with a new facilityat Sighthill in December 2006. The City of Edinburgh Council is currently conductinga public consultation which sets out its intentions for the Meadowbank site. Commentsare sought by 30 March.

Since 2003 East Lothian,Midlothian, Moray and West Dunbartonshire are the only councils which havereported a transfer of funds from the Housing Revenue Account (HRA) to theGeneral Fund. The Executive does not collect information on which specificservices were funded from transfers from the HRA.

To ask the Scottish Executive whether the Accountant in Bankruptcy has the power to consider what remedies are available to Farepak customers in Scotland in receipt of benefits under the Social Security Administration Act 1992 with regard to recovering monies lost and, if so, what action the Accountant in Bankruptcy has taken in this respect.

Corporate insolvency, suchas the Farepak Administration, is reserved for the UK Parliament under Schedule5 of the Scotland Act 1998 and as such the Accountant in Bankruptcy does nothave any powers to assist Farepak customers.The Accountant inBankruptcy, as trustee in a personal sequestration, can make a claim in the administrationof Farepak where the debtor is due monies. This would be on the same basis asall other Farepak customers and would be treated as an unsecured creditor’s claimin the administration. In a sequestration where the debtor had made paymentssolely out of social security benefits to Farepak, any money recovered would bereturned to the debtor under section 187 of the Social Security Administration Act 1992.

The responsibilities of the Ministryof Defence are reserved to the UK Government and so no Barnett consequentials cometo the Scottish Executive as a result of allocating resources to defence.Only if the UK government reallocated resources to another UK Department, to be spenton functions with a devolved comparator, would any additional resources come toScotland. It would be misleading to suggest that therewould be any automatic additional resources available to the Scottish Executive.
