It was moved by the Lord Thomas of Gresford, in Clause 63, page 41, line 40, at end to insert: “( ) Subsection (2) does not apply to evidence which was discoverable by reasonable and diligent inquiry before or at the proceedings in which the person was acquitted.”; which being objected to, the question was put thereupon, and the House divided:
